Waiver, Release of Liability, and Participation Agreement

By enrolling in or participating in any class, program, or activity, whether in person or online (hereinafter referred to as the “Activities”) offered by the Tracker School (the “School”), you acknowledge and agree to the following terms and conditions in their entirety. Please read this waiver carefully, as it affects your legal rights.

1.      Acknowledgement and Assumption of Risk

I understand and acknowledge that participation in outdoor and nature-based activities involves inherent risks. These activities take place in natural, often unpredictable environments, and may involve physical challenges that carry the possibility of both minor and serious injury, and in rare cases, even death.

By participating in the activities, I voluntarily assume all risks, known and unknown, associated with participation in the Activities.

Such risks may include, but are not limited, to minor injuries such as scrapes, bruises, insect bites, and sprains; more serious injuries including broken bones, burns, allergic reactions, and other medical emergencies and life-threatening conditions or fatal incidents in extreme or unforeseen circumstances.

Specifically, I understand that the following hazards (among others) may be present:

• Natural hazards such as uneven terrain, falling branches, exposure to plants, insects (including bees), and other wildlife;
• Tick exposure and associated risks (e.g., Lyme disease and other tick-borne illnesses);
• Physical injury from tripping, falling, dehydration, heat exhaustion, or sun exposure;
• Injury from use of tools and materials (e.g., flint knapping, carving tools, fire making equipment); and
• Limited or delayed access to emergency medical care in remote or wilderness areas.

2.      Release and Waiver of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless the School, its officers, directors, instructors, volunteers, employees, agents, and affiliated entities (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, illness, or death that may occur during participation in the Activities, whether caused by the negligence of the Released Parties or otherwise.

3.      Health and Medical Requirements

I agree to notify the School of any allergies, dietary restrictions, health conditions, or medical needs that may affect my participation in the Activities as promptly as possible after registration. I hereby certify that I am physically capable of participating in the Activities despite the rigors and dangers inherent in such undertaking.

I acknowledge that I am responsible for bringing and maintaining any necessary prescription medications or medical supplies (e.g., EpiPens, inhalers) during the Activities and that I must continue taking prescribed medications during the course of any program as directed by my healthcare provider.

I further acknowledge that there is no obligation of any person to provide any participant with medical care during or after the Activities. In the event medical treatment is provided to me, I hereby consent to such care, and, for the avoidance of doubt, Section 2 shall apply to such medical treatment.

4.      Alcohol and Drug Use

I acknowledge that the use of any drugs or any amount of alcohol is prohibited during the Activities and that violation may result in immediate dismissal without refund.

5.      Personal Property

I understand and agree that the School is not responsible for the loss, theft, or damage of any personal belongings I choose to bring to the Activities.

6. Intellectual Property and Content Usage

All course content, including materials, lessons, videos, feedback, and communications, are the exclusive property of the School. This includes, but is not limited to, written materials, handouts, and online posts; audio and video recordings; instructor and student commentary; chat room and discussion board entries; and images and photos taken during classes.

You may use these materials for personal, non-commercial use only, and may not share, distribute, reproduce, or republish them in any form, with anyone not enrolled in the class. Links to online classes, discussion groups, chat rooms and recordings may not be shared.

7.      Media Release

By participating in any Activity offered by the School, I grant the School the perpetual, worldwide, royalty-free right to record, use, reproduce, and publish any audio, video, or photographic recordings of me taken during past, current, or future classes. This includes my likeness, voice, image, written feedback, and participation for educational, promotional, or marketing purposes.

I understand that all such media, whether created by staff, instructors, or participants, is the sole property of the School. I acknowledge that I have no claim to copyright, ownership, or compensation for the use of these materials.

8.      Restrictions on Participant Recordings

I acknowledge that I may not record any audio or video during in-person or online classes without the School’s prior written permission or explicit direction from an instructor. Still photos are permitted for personal use only and may not be shared with anyone who was not enrolled in the same class.

9.      Use of Participant Feedback and Communication

I understand that any comments, feedback, or responses I submit through class chat rooms, discussion groups, email, or other course-related platforms may be used by the School for educational or promotional purposes. All such submissions become the property of the School.

Instructors may read my feedback aloud during class, including my name, unless I explicitly label my submission as “CONFIDENTIAL” or similar. In that case, my name will be withheld, although the content may still be used anonymously.

I agree that the School may add me to one or more communication channels for the purpose of sharing class information and fostering community (e.g., email groups, online forums, or messaging platforms). I understand that other participants may see my name and email address within these channels. I may choose to leave or unsubscribe from these channels at any time.

10. Code of Conduct and Dismissal Policy

All participants are expected to behave respectfully and responsibly. The School reserves the right to remove any student from a class without refund for disruptive, disrespectful, or inappropriate behavior, violation of safety rules or failure to comply with this waiver and release.

11. Governing Law and Severability

This agreement shall be governed by and interpreted in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes arising out of or related to this agreement shall be brought exclusively in the courts located within Ocean County, New Jersey, and I hereby consent to the jurisdiction and venue of such courts.

If any provision of this agreement is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect. The language of this agreement shall be interpreted as a whole, according to its fair meaning, and not strictly for or against any party.

12. Binding Agreement

By purchasing or participating in any program through the School, you affirm that (i) you have read and understood this waiver and release, (ii) you are voluntarily participating and assume full responsibility for your safety and conduct, (iii) you agree that this agreement is binding upon you and your heirs, legal representatives, and assigns.
